WHAT IS MEDIATION?

Mediation is a confidential procedure
in which a third party (a mediator) helps disputing individuals (the parties) discuss, negotiate and investigate options for settling conflicts. The mediator has no power to make a decision, does not take sides or give legal advice. A mediator is there to facilitate and guide conversation so that a resolution can come about.

Mediation is a service for commodity and service businesses that find themselves overwhelmed by the “differences in opinion” inherent in everyday transactions. Mediation provides businesses with a way to clear disputes off their desk in a positive manner and focus on their original duties of running a business.

Mediation can provide swift and discreet resolutions to disagreements, before they become noticeably public headaches. It can also build continuing relationships that are often necessary in the everyday world.

Unlike small claims court or civil court, mediation in not recorded publicly or legally as a judgment. In mediation, the outcome is confidential. When an agreement is made through mediation, the success rate is very high for follow through.

Also, mediation can provide faster resolutions. Small claims court and/or civil court can take months and sometimes as much as a year to even be put on the docket, whereas mediation can be scheduled as soon as one week. In addition, court costs can become extremely expensive, whereas mediation has already been proven to be more cost effective.

I am a mediator. I provide services, both as a neutral mediator between disputants, and as a mediation consultant for disputes that will be heard by another mediator.

Mediation can help anyone including: employers, employees, clients, independent contractors, and vendors. The key is the willingness to try.
